In a criminal trial, defendant is not required to testify and such failure may not be commented on by judge or prosecution because of protection of Fifth Amendment, U.S.Const. Griffin v. California, 380 U.S. 609, 85 S.Ct. 1229, 14 L.Ed.2d 106.
